For a long time, the theoretical knowledge generated about law was predominantly philosophical, but with capitalism comes the need for technical and dogmatic knowledge that gives the right the security that commercial transactions need. In view of this, the theory of law appears and, within the context of the birth of social sciences as a science, the so-called “Pure Theory of Law” designed by the Austrian Hans Kelsen.
